Consultation procedures
On this page you can find the consultation procedures of the Zentrale Stelle Verpackungsregister (Central Agency Packaging Register – ZSVR).
The ZSVR conducts consultation procedures within the remit of its statutory tasks only. The type and scope of the various consultations are structured according to administrative procedural provisions as well as antitrust regulations on a case-by-case basis with regard to the different legal implications of the decisions and the extent of their impact.
Administrative regulations
The Verpackungsgesetz (Packaging Act) grants the ZSVR the power to make certain decisions through administrative acts and to set administrative regulations.
Administrative procedure law does not require consultation procedures for administrative regulations. These generally concern norm-interpreting administrative regulations without an immediate external impact. There is potential for the actual impact on competition to be significant, however, so that consultations are generally required under antitrust law.
To give the parties under obligation as per the Verpackungsgesetz the opportunity to make comments in writing, the ZSVR usually publishes draft versions of administrative regulations. Information about these consultations will be published on this page. Following evaluation of the comments received, the ZSVR then publishes its administrative regulations as amended.
