Explanation
Packaging for agricultural chemicals and pesticides for use in homes and allotments is not retail packaging for hazardous contents within the meaning of section 12 (2) no. 3 VerpackG in conjunction with section 3 (7) and appendix 2 VerpackG.

Retail packaging and grouped packaging for agricultural chemicals and pesticides for use in homes and allotments in quantities of 28 kg or less are subject to system participation because they typically accumulate as waste with private final consumers – i.e. private households and comparable sources of waste generation (within the meaning of section 3 (11) VerpackG) such as pest control businesses, agricultural holdings and gardening and landscaping enterprises whose packaging waste can be collected at the rate that is normally associated with private households in waste bins that do not exceed 1,100 litres ('volume criterion').
