Explanation
Retail packaging and grouped packaging for yoghurt and ready-made desserts in quantities of 14 kg or less are subject to system participation because they typically accumulate as waste with private final consumers – i.e. private households and comparable sources of waste generation (within the meaning of section 3 (11) VerpackG) such as food and beverage businesses, canteens and commercial kitchens. Comparable sources of waste generation also include artisanal food production businesses whose packaging waste can be collected at the rate that is normally associated with private households in waste bins that do not exceed 1,100 litres ('volume criterion').

Shipment packaging for yoghurt and ready-made desserts of all kinds typically accumulates as waste with private final consumers – i.e. private households and comparable sources of waste generation and, as such, is subject to system participation.
Specials
Drink cans with a volume between 0.1 and 3 litres, filled with other drinkable dairy products within the meaning of the Milch- und Margarinegesetz (Milk and Margarine Act), especially yoghurt and kefir, are subject to deposit pursuant to section 31 (4) no. 7G VerpackG. Due to the deposit obligation, this packaging type is exempt from the system participation requirement under section 12 (2) no. 2 VerpackG.
