Explanation
Retail packaging and grouped packaging for milk and milk drinks in quantities of 28 litres or less are subject to system participation because they typically accumulate as waste with private final consumers – i.e. private households and comparable sources of waste generation (within the meaning of section 3 (11) VerpackG) such as food and beverage businesses, canteens and commercial kitchens. Comparable sources of waste generation also include artisanal food production businesses whose packaging waste can be collected at the rate that is normally associated with private households in waste bins that do not exceed 1,100 litres ('volume criterion').

Retail packaging and grouped packaging for milk and milk drinks in quantities exceeding 28 litres is not subject to system participation because they typically accumulate as waste in industrial or large commercial enterprise settings. In addition, milk and milk drinks are usually shipped in tanks or comparable bulk containers (e.g. IBCs) for further industrial processing.
Shipment packaging for milk and milk drinks of all kinds typically accumulates as waste with private final consumers – i.e. private households and comparable sources of waste generation and, as such, is subject to system participation.
Specials
Beverage cans in quantities between 0.1 and 3 litres containing milk or milk drinks with at least 50 per cent milk content are subject to deposit under section 31 (4) no. 7f VerpackG. Due to the deposit obligation, this packaging type is exempt from the system participation requirement under section 12 (2) no. 2 VerpackG.
